Public Nuisance - 6.13

6.13.010 Public nuisance

Any animal that menaces or attacks persons, vehicles, or other animals, goes upon school premises without the owner gaining permission from the principal, damages, destroys, or injures any shrubbery, plants, flowers, lawn, fence or other property, either public or private, or is found upon a public park running at large, is declared to be a public nuisance, and the owner or keeper shall be deemed responsible for the actions of the animal and financially responsible for all damage caused.

6.13.020 Possession of barking dogs

It shall be unlawful for any person to own, possess or keep any dog which shall disturb the peace and quiet of any person within the Town by persistent or continual barking, yelping, whining, or howling.

6.13.030 Impounding

In addition to the penalties provided herein for the violation of Title 6 Animals, any barking dog may be seized and impounded by the code enforcement officer whether or not the barking dog is on or off the premises of its owner, and the dog may only be released to the owner, possessor or keeper of the dog upon payment of all fees required in Title 6 Animals and the dog being muzzled or otherwise prevented from a repetition of such continual, persistent howling, yelping, whining or barking.
